He's not actually arguing against discrimination's rightness or wrongness prima facie.

Instead he's making a few different arguments.

1.) that laws should appear race neutral because they will stand up to legal scrutiny better.

2.)he doesn't want the government to be held responsible for discrimination of private individuals. Effectively meaning he doesn't want the government intervention into.racism and believes the government turning a blind eye to it is acceptable.

Further, he solidifies this position by saying it would be nearly impossible for private citizens to prove the government was indifferent to the discrimination citizens are experiencing


3.)lastly, he appears to make the argument that he wants to limit which native Americans have recourse based on tribal affiliation and activities and more so that they be represented by the tribal council - - think forced arbitration.
