Sean Kelly said they were all beating up Megan, not that Meg and Kelsey were fighting. He said that he saw flashes from Kelsey and it looked like she was shooting into the car, then he saw Tory fire shots in Meg’s direction and that’s when she fell on the ground.

Tory’s lawyers argued that he never fired the gun, which is directly contradictory to Sean Kelly’s story and this supposed bodygaurd’s story.

Both sides called forensic experts.

Both experts testified that most times in a situation like this DNA on the weapon IS inconclusive. It very rarely can be isolated to one person.

They both also testified that most times a person is convicted for being a shooter, it’s not due to DNA on the gun.

His DNA on the gun or not was not a requirement for the prosecution to prove their case.

With the full information from the experts in court the jury decided there wasn’t enough “doubt” there.

The DNA on the gun was inconclusive, but was positively identified as male DNA.
