Correct - but setting up the executive order solidifies the claim. Then the President can call for/create a Presidential commission for the H.R.40.

And on a controversial issue like reparations, improving the terms of the debate is essential to moving forward.
Because of the ease with which presidential commissions are created and the number of them presidents establish, they are sometimes cast as ineffective, low-cost tools to satisfy political demands without actually delivering policy solutions or reform. But when it comes to matters of civil rights and racial injustice, history demonstrates that American presidents have had to use the powers of the presidency to force the nation to confront its race issues rather than waiting on congressional action.
