The internment is by executive order. The Congress issued the reparations.

Correct - but setting up the executive order solidifies the claim. Then the President can call for/create a Presidential commission for the H.R.40.

Presidential action is also necessary because it’s the surest route to a study, and such a study might be the only viable first step in the process because it could grease the wheels for a more productive national discussion on the issue. And on a controversial issue like reparations, improving the terms of the debate is essential to moving forward.

Because of the ease with which presidential commissions are created and the number of them presidents establish, they are sometimes cast as ineffective, low-cost tools to satisfy political demands without actually delivering policy solutions or reform. But when it comes to matters of civil rights and racial injustice, history demonstrates that American presidents have had to use the powers of the presidency to force the nation to confront its race issues rather than waiting on congressional action.

By the President issuing an executive order - it gives ADOS a claim. The executive order can be for the study -- then they go from there -- creating a bill -- or passing the H.R. 40 with a resolution attached.

This is a slightly different point. If you saying that the next president should issue an executive order for the reparations commission then yes that can happen. But to actually get the funds it will need to go through Congress. So I do want the next president to be vocal about reparations, but I have no problem getting it passed through HR40 since it will eventually have to go back through Congress anyways.

This is clown shyt. How is supporting HR40 pandering? It is a ridiculous statement. HR40 pushes the conversation about reparations forward. Would she prefer that Warren not support the bill? It literally makes no sense.

I’m don’t think reparations can be passed through executive order. The money would have to be approved by Congress. The way the process works is that the president submits the budget then congress have to approve it. If she have proof that reparations can be passed without congressional approval I’ll change my opinion.

Reparations/extensive government spending programs cannot be passed through presidential executive order.

This is why Trump has been unable to secure funding to build the border wall.

He's tried an end-around by declaring a state of emergency to allocate funds for the wall already approved by Congress for other measures.

Government appropriations, especially federal funding at the level of what is being demanded for ADOS reparations ($500 billion - $20 trillion) can only occur by approvals of the House of Representatives and the Senate, and then a presidential signature of that bill.

"The president has the power to issue executive orders to implement a federal statute or the Constitution. If the president issues an executive order outside of his delegated authority, courts will enjoin its enforcement. That is what happened when the lower courts enjoined a dozen executive orders requiring federal agencies to stop deporting undocumented aliens, to aid in their resettlement, to issue them work permits, and so forth. The Supreme Court refused to overturn the injunction. The president does not have the power to waive the immigration laws. One study by the Mercatus Institute argues that President Obama has used “more restrictive executive orders” than the six previous six presidents have.

An important limit on executive orders is that the president needs Congress to appropriate funds. Article I, §9, clause 7 states, “No money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law.” The Appropriations Clause is an important part of the lawsuit that the House of Representatives brought against that the Administration, claiming that it is spending funds that Congress has not appropriated. Thus far, the district court held that the House of Representatives had standing to challenge Executive Branch’s actions in drawing funds from the Treasury in the absence of a valid appropriation. That court later enjoined the expenditure of funds that Congress did not appropriate and stayed its injunction pending appeal."
