They definitely could have avoided the kill for sure, especially seeing as it appears dude didn't have a gun on him.
That said, I don't think targeting feet are a good idea. Cops are trained to go for the big targets, especially the body first and foremost. But even if they decided to shoot for some bizarre reason, one shot should suffice. The guy isn't terminator lol...
