Sony does have the ability to ban people's accounts on psn. And they've done it (google is your friend).
No. Now that hackers have access to the "master key" Sony can do nothing to detect the modded consoles/games being played on their network.
There is a reason previous COD games have been deemed "unplayable" on PSN by infinity ward.

A forum post with sony's policies is proof of nothing at all. Obviously it's forbidden to use the hacked consoles online. The problem is SONY HAS NO WAY TO DETECT/STOP hacked consoles from signing into PSN. Hell you don't even need a console anymore, people are logging on to PSN with their PCs
