SAN DIEGO – A local rapper who has spent eight months behind bars for his song lyrics may soon go free.

A judge has dropped conspiracy ATTORNEY , Brian Watkins, talked to 10News on the phone after the ruling.

“His spirits are up now,” said Watkins. “It’s been a terrible situation for him. He’s been in jail for over half a year.”

Duncan and 14 other gang members were charged in a gang conspiracy involving nine shootings since April 2013.

Duncan has not been tied directly to the shootings, but he is the first person to be charged under a little-used statute approved by California voters in 2000 that allows for the prosecution of gang members if they benefited from crimes committed by other gang members.

In a jailhouse interview with 10News, he said his album “No Safety” is merely about urban culture and does notPROMOTE gang violence.

“I’m just painting a picture of a story, that’s it,” Duncan said. “I’m not telling anybody ‘hey go commit this crime.'”

In court, the judge found no proof that Duncan knew anything about any of the shootings or that he benefited from them in any way.

Duncan will be back in court on Friday.

San Diego rapper and gang member Brandon Duncan, a.k.a. "Tiny Doo," was not one of the five members of a criminal gang conspiracy case that had charges dropped in court Wednesday, the District Attorney's office said.

A group of 33 active gang members are a part of a high-profile case related to 24 shootings in recent years, including three murders in Southeast San Diego. Because of the number of defendants, the case was split up and assigned to two different judges.

For five of the defendants, one of those judges dismissed a specific conspiracy charge that "allows prosecutors to charge active gang members who had knowledge of the gang’s violent activities and who are promoting, assisting and benefiting from the violent crimes committed by their fellow gang members and to hold them responsible for their involvement," a release said.

Duncan, however, was not one of those defendants.

Sounds like the same bullshyt law they got C-Bo with years ago. They were threatening to violate his parole if he made any gangsta music but he did it anyway. I don't know if he ever went to jail over it tho
