Above the fray.
DJ Envy got sued for the same thing with his "Carchella"event.
He lost that case.

Thanks. Wow, never saw a ruling worded like that. It's assumed that when you're blocked from using something that it's for as long as the other party holds the trademark.
That ruling hit Envy with the Dr. Umar line, though. "permanently"
FOR GOOD!

They're gonna bury them. This a tweeted response from one of the people behind Afrochella. MFer actually wrote this in response to some random person asking a question.

Coachella sues Ghana’s Afrochella for trademark infringement

8th October 2022

Coachella in 2019

Coachella and its organisers Goldenvoice have filed a trademark infringement lawsuit against Ghana-based festival Afrochella.
According to the suit, which was filed in a California federal court on October 5, Goldenvoice claim that Afrochella (via Pitchfork) is “intentionally trading on the goodwill of well-known Coachella and Chella festivals and trademarks by actively promoting music events in the United States and in Ghana using the confusingly similar mark Afrochella”

The suit continued: “Not simply content to imitate and attempt to trade on the goodwill of Coachella, Defendants even went so far as to apply in Ghana to register Coachella as their own trademarks.”

“Despite repeated requests from Plaintiffs, Defendants have refused to adopt their own distinctive event name, and as a result, instances of actual confusion have already appeared on social media.”
The lawsuit “seeks injunctive relief and damages for Defendants willful infringement in the United States and to protect the public here from confusion”

Back in 2017, former Afrochella boss Edward “Deezy” Elohim took to Twitter to call the festival a “Coachella themed event”.

According to their website, Afrochella “is a celebration of Africa’s diverse culture and the vibrant work of African creatives and entrepreneurs.”
Afrochella 2022 is scheduled to take place on December 28 and 29 at El Wak Stadium in Accra, Ghana.

Coachella is set to return in 2023, with its now-traditional two weekends set to take place between April 14-16 and April 21-23.

Damn. I wanted to give them the benefit of the doubt, but after reading the doc, and reading that they really did try to register both Coachella and Chella festivals in Ghana, makes me believe that there was an intent to scam.

Moechella Organizers Lose Trademark Dispute, But Go-Go Lives On

The fight to trademark “Moechella” — the name of D.C.’s popular go-go music protest on 14th and U Streets NW — has come to a halt.
The name “Moechella,” a play on local slang for another person, “moe,” and the California music festival Coachella, has drawn backlash from the latter’s lawyers, who say the name infringes on their trademark rights. Coachella’s lawyers attempted to block a trademark application that Moechella’s organizer, Justin “Yaddiya” Johnson filed in April 2021 to keep the name. (Coachella did not respond to a request for comment). Johnson, who is also the founder of the cultural and political advocacy organization Long Live GoGo, withdrew the application on July 29. The Trademark Trial and Appeals Board terminated the case on Aug. 2.

Afrochella Is Not Ending. Instead, Rebranding To 'Afro Future Fest'

Afrochella is not ending! Instead, one of Ghana’s premiere festivals that celebrates Black music, art, fashion, and culture – is rebranding into Afro Future Fest.
“We’re still in the early stages of rebranding but the festival isn’t ending out right,” a spokesperson tells Travel Noire. “The brand is just transitioning from Afrochella to another name.”
There are very few details on the brand’s new name, but the spokesperson confirms the team has already gone live with a few posts on social under the name “Afro Future Fest.”
This is certainly good news following a shocking announcement from one of the co-founders that the festival would be ending

fukk around and find out what happens when you blatantly tread on well known intellectual property, brehs.

all of those cats who are getting pressed by Nike these past couple of months are learning that the hard way.

So why even try to use aspects of the Coachella brand? Build your own dope ass festival, make it look good, break bread for top artists and don’t shyt on your audience by chafing crazy ticket prices.
