First off, I know to sue employers in right to work states, it typically has to be discrimination based on race, gender, age, sexual orientation, or veterans status.

But this don’t really fall under that. It’s retaliation.

To be brief as possible but leave in the important details.

I’m a financial analyst. About a year ago, they moved me from finance to Accounting. Told me my role and duties would stay the same but that my role belonged it a different department.

Clearly I knew that they would add some extra duties. But what ended up happening is, they started adding a lot of duties and kind throwing me under the bus and fukking up my work reputation. Also, I’m like fair is fair, I will ask for a raise.

So I went to my boss like yo, can y’all give me an official list of my duties and responsibilities, cause I’m unclear on how hats expected of me. Also, once I had this, I could raise concerns about stuff I didn’t know how to do and show how my duties have increased and ask for a raise. She went to her boss and they said no problem. But they never gave it to me and kept adding duties and playing these little games.

So I called a meeting with my boss. Basically said what the fukk going on. She was straight up with me. She said they trying to have you take on a whole nother role. I asked, will I relinquish any duties from my financial analyst role. She said no. I don’t as like the fukk, that’s two jobs. Y’all got me fukked up.

So a few weeks went by and some more bullshyt happens and I asked for my duties to be defined again. But this time it was in an email.

Unbeknownst to me, this put them on notice cause they supposed to been gave me that shyt. So with them having corporate experience and being evil, they got out in front of it and went to HR lol. Next thing you know, I’m getting written up 2 days later for not meeting metrics lol. But I NEVER had metrics for my job. I guess they needed to justify the write up so they made up metrics and retroactively applied them to my past work smh.

So I told these folks they got me fukked up and I refuse to acknowledge the shyt cause what type of nikka with integrity would do so. I told my boss to her fat ass face on more than 20 occasions that I the shyt was retaliation and they gotta fire me before I sign the shyt. So that little probation was for 90 days.

It’s been bout 100 days. I sent an email to my boss yesterday basically asking am I off cause I need my name cleared cause it had no merit in the first place cause it was retaliatory.

Man this hoe replied that she forwarded to HR. I asked this hoe why and she said cause I used the word retaliatory. I replied back that I used that word to your fat ass face more than 20 times, so why wasn’t HR contacted them? She never responded

Now today HR some reached out to me trying to meet. I told them I’m not talking to them and never requested to do so. But they saying they want to get my side of the story. I know better from dealing with them last time that they like the police. They work for the company and only concerned with getting sued. So anything you say will only be used against you. The butch emailed me like 3 times trying to convince me to talk. I clearly asked her am I required to talk because I don’t want to , but want to make sure I’m following protocol. The bytch refuses to answe the question.

A lawyer supposed to call me for a consultation at 5:30 but wanted some advice from Breh and Breh associates. Unless my job straight up made fake paperwork or documents, they can’t show any prof where my role had metrics or where they ever discussed metrics with me, so to me, the probation they put me on was clearly without merit.

Going forward... Email is your friend
Never verbally ask for anything, always put any formal request in writing, ortherwise its your word against theirs. As far as HR is concerned, draft an email that enumerates all the times you asked for clarification on your job title/duties; including dates and who you made these requests to.
Your language has to remain neutral at best or passive aggressive at worst.
Let this be a lesson... They might have enough to get you out the paint cause you lack a paper trail(emails) that shows your requests for clarification

All fax, they are there to protect the company from suits, they not the employee advocate in reality.

Wouldnt it be easier to find a new job?

Pretty sure OP mentioned finessing his way into this current job:hubie:

Hope he can get some advice though

I did but that’s irrelevant lol

I can already tell you that you talk too much. You ain't supposed to mention retailiation until a post employment situation

I mean, this my first corporate job like that. I’m learning a lot as I go on how to move around corporate and definitely have learned to keep your word to a minimum. Also, like o said in the OP, I been said it was retaliatory. There was big issue with me refusing to acknowledge the write up and that was the main reason why. Wasnt until I put it in email that they got serious I guess

That’s true, but to my point about why they wrote me up, they lack paper trail for that as well. They can’t show any documentation where I ever had metrics related to my role. So I feel like that fact helps proof my case that the write up was without merit. And if it didn’t have merit, what was the reason? Retaliation.

But yes, I have learned that documenting shyt is your friend. I know what to do going forward.

Also to the point about losing my job. First off, I legit felt like they were a little scared of litigation when this smforst happens and that’s the only reason they didn’t get me out the paint. Cause I actually do a good job and they knew the write up wasn’t with merit.

Also, I’m being laid off. Don’t got the exact date yet, but should be around February. We merged with another bank and I feel like they just used that opportunity to lay me of. So it’s a weird dynamic cause I know I’m being laid off soon.

I am a little worried about getting fired and losing my severance. But at this point I feel like my case for retaliation will be stronger if they fired me now

Im glad you're learning as you go.
Just a word of advice from personal experience... As a black person in a white dominated corporate environment, you arent there to be yourself, youre there to do a job. My coworkers have no idea about my real personality. They think im very conservative cause i dont engage in work gossip or political discussions. My non work related interactions are limited to sports with my male coworkers and the weather with my female coworkers. I always Cover My Ass with anything that isnt above board by getting out in front and sending emails and CCing those who are pertinent to said email.

My main goal is my paper. I dont want to be friends with any of my coworkers. We have a good working relationship and most interactions rarely stray too far from work related topics. They all know im pleasant, hard working(so they think) and good at my job. They cant come at you sidewise if their perception of you is largely framed through the prism of your work duties. ALWAYS DOCUMENT STUFF THROUGH EMAIL!!!

And oh... Start updating your resume if you know the hammer is about to drop. Sounds like you need a fresh start. Hopefully at the next job you start hustling correctly

Yeah I’m definitely learning a lot. I’m not with that friend shyt, but im learning that I need to say as less as possible. I’m too direct with these folks. They intimidated and resent that shyt. I look at it as, as long as I’m being professional, I’m gonna say what’s on my mind. But these folks are passive aggressive and will just use corporate tactics to halt your growth, fukk with you, or get you fired.

Yeah already tightened up the resume last week and had a phone interview for two jobs already. Found out my market value jumped by like 20k from them interviews so I’m good. I’m not even in a rush. I’m trying to make it to I get laid off, get my severance, then get a new job. I leave before they lay me off and I don’t get my severance.

Your first move is to see the eeoc & the eeoc will bring your concerns to the company or tell you to get a lawyer . Go out sick & use that stress leave to deal with the eeoc

Are you trying to sue these guys while you work there? :francis:

I feel like at this point if you find a lawyer to take the case you still just want to get a nice severance package where they make you sign something that says you won't sue.

What are you going to do, go back to work there like it's all good?

And that's only really happening if they accidentally emailed about conspiring against you, since that would come out in discovery.

I don't think you have great odds but I am pulling for you breh fukk those cacs, fukk corporate and fukk HR you learned that lesson the hard way HR is the opps.

Idk what your other options are but if you make a post in 6cert brehs might have some other ideas for you. @ me if you do, I have a few more years than you in a similar industry.
