Say Party A and B signed a contract on December 1st 2018.
1. Under the contract signed in Dec 1st, party Party B was supposed to pay Party A 15k within 10 days after signing the agreement, provide a condo unit facing the waterfront.
2. On December 21st Party A requested to amend the contract by requesting a condo unit opposite of the waterfront instead of facing it. Party B agrees, and a New contract was signed on December 22nd 2018 replacing the original contract signed on December 1st.
3. On Janaury 14th Party A realizes after checking the bank account that Party B transfered only 10k instead of the agreed 15k. Which was signed on December 1st.
Party A submits a claim for misrepresentation, party B argues that contract signed on December 1st is no longer valid and that replacement contract was signed on December 22nd.
