There is a difference between a cop finding something in your general vicinity, and a cop witnessing you drop something on the ground. if they witness you drop it you're in possession. And the majority of cops will lie anyway. They find a bag of dope on the ground they'll say they found it in your pocket. Whether or not they actually saw you touch it.

10 grams is not a charge. Yea if its bagged separately they can technically hit you with the intent to deliver. They can also technically give you a year in jail for walking on someones lawn. Fact is the prosecutors not gonna waste time trying to convict you on some baby charge.

OP clearly stated that the cops didn't know who the weed belonged to in his post, so obviously I'm speaking on similar scenarios.

Under a zip and case is getting thrown out. Prosecutor does not have time to take every case to trial. Surefire conviction? They're gonna spend all that money taking you to trial for what? To give you a year of probation? That is not how the justice system works. And depending on the cop you won't even get booked for having weed on you. Speaking from experience.

Constructive possession =/= throwing a bag on the ground as the cops are pulling up on you. if you're already in the cut, you hear the cops pull up, and you drop your shyt off and keep it moving thats could be considered constructive possession. And its common sense to drop your shyt in that scenario.

in ops scenario cops pulled up as hes standing in front of a building in full view of the squad car. in that scenario you throw your shyt the cop WILL see you and you just gave him probable cause to detain you, search you, throw the dope bag back in your pocket, and book you. Nobody operates like that. There is about 4 things you can do to get away in that scenario. Dropping your shyt on the ground in full view of a the police is not one of them. You sound like a pig tryna get people caught up right now.

you're generally a good poster but this was a stupid fukking thing to say. people go to jail on small amounts of weed everyday, even in 2015. ive gotten multiple charges on shake they found on the floor of my car. alot of states still treat weed as a dangerous drug
