The neglible amount of alcohol he blew isn't ability impaired. The legal limit of .08 is barely even a buzz, and he blew less than 1/8th of that.
Even if the designated driver is proven sober, you still have multiple people under 21 admitting to consuming alcohol. That's illegal.According to the news release, the officer detected an odor of alcohol coming from the vehicle. The passengers all said they had consumed alcohol at a party before the driver picked them up.

Cops mostly just care that the driver is sober. I think you might actually be able to blow a false positive from recent use of mouthwash.
I mean, the legal system should have to prove beyond reasonable doubt that the driver is actually ability impaired, it would be bullshyt to get a DUI over a miniscule BAC which may not even be from drinking.

Maybe...but that doesn't change the fact is Minor in Possession is a crime. It doesn't matter if the driver is sober or even if there is a driver. They could be walking down the street and it would still be illegal. If the kids were black we wouldn't be having this discussion.They weren't driving.... Most officers aren't arresting 17-19 year olds at 3 AM just because they had some beers at a party..... If the driver passed the field test and breathalyzer......![]()
