Even if the designated driver is proven sober, you still have multiple people under 21 admitting to consuming alcohol. That's illegal.
And they still didn't get arrested.

I think you might actually be able to blow a false positive from recent use of mouthwash.
I mean, the legal system should have to prove beyond reasonable doubt that the driver is actually ability impaired, it would be bullshyt to get a DUI over a miniscule BAC which may not even be from drinking.

Cops mostly just care that the driver is sober. I mean yeah if you're 18-20 and found in posession of alcohol you might get a ticket, but it's unrealistic to arrest someone in this age group just for being drunk.
None of them were even charged with Minor In Possession.

Minor In Possession can be charged anytime u prove minors (under 21) consumed alcohol. They admitted to consuming alcohol before the driver picked them up.
"According to the news release, the officer detected an odor of alcohol coming from the vehicle. The passengers all said they had consumed alcohol at a party before the driver picked them up."

Maybe...but that doesn't change the fact is Minor in Possession is a crime. It doesn't matter if the driver is sober or even if there is a driver.
