Man faces federal charges for alleged threats to Jason Van Dyke, his family


"A federal indictment made public Thursday alleges a Southwest Side man threatened the lives of Jason Van Dyke and his family in a slew of social media posts during the Chicago police officer’s trial in the shooting death of teenager Laquan McDonald.


The indictment filed last week in U.S. District Court charged 32-year-old Matthew Ross, of the Ashburn community, with three counts of making online threats. Ross faces anything between a fine to a maximum of five years in prison on each of the three charges.

Ross was originally arrested in October in the lobby of the Leighton Criminal Court Building when he showed up to attend closing arguments in Van Dyke’s trial. Ross was charged with two misdemeanors and released by a Cook County judge on a personal recognizance bond. The charges were dismissed at his next court hearing in November, court records show.

Two months later, federal authorities are hitting Ross with charges alleging he began making threats in August in the lead-up to Van Dyke’s trial."

In the first message noted in the indictment, Ross allegedly wrote in a Facebook post on Aug. 7, “SO IF I GOT A HIT SQUAD TOGETHER TO SHOOT 70 FAMILY MEMBERS OF CPD OFFICERS THIS WEEKEND…..THEY’LL BE NO SUSPECTS MONDAY MORNING?? #GETTHESTRAP FREE YOUR SOUL!!!”

Ten days later, Ross posted, “CHICAGO POLICE’S WIVES & CHILDREN NEED TO BE SHOT!! GOOD NIGHT FREE YOUR SOUL!!” according to the federal indictment.

Robert Peralta’s life was derailed by a single Facebook comment.

When the San Franciscan saw a well-known local activist had posted about being “choked” and “slammed” by a sheriff’s deputy at city hall, Peralta fired off a short response: “Wow, brother they wanna hit our general. It’s time to strike back. Let’s burn this motherfukker’s house down.”

Peralta, a 35-year-old activist and musician, didn’t think twice about the 23 January Facebook thread until two months later, when he learned that police had issued a warrant for his arrest – accusing him of threatening to kill law enforcement.

Threatening to kill ANYONE is a crime.

Now, you're reaching because your argument is trash.

Also, according to the Supreme Court "Only true threats can be punished".

What constitutes a 'true threat'? This generally means that the threat must be credible and specific enough that a reasonable person would be threatened.

Me saying 'Imma come to your house and kill you in your sleep' is NOT credible as I don't know where you live or even care enough about you to kill you.

Should it be a crime to call public officials corrupt? Yes, according to the police in Exeter, New Hampshire. Earlier this year, they arrested a local man for writing a comment on a news website accusing Police Chief William Shupe of covering for a corrupt officer.

Robert Frese was accused of violating New Hampshire’s criminal defamation law, which makes it a misdemeanor to intentionally and falsely disparage another person. New Hampshire’s law — and others like it in 23 other states around the country — literally make it a crime to say mean things about people.
