That dude on CNN dropped a bomb or at least one to me. If a suspect surrenders(arms up) than deadly force is no longer required and the cop can be charged. So even if dude was jostling for the weapon, by surrendering jostling for the weapon became meaningless and all that mattered is the cop shot him.
