Texas only has 30k minimum for bodily injury . Most people have minimum. Her injuries are not gonna be covered. They gonna sue these folks and take their house.

Plus 125 for the mailbox.

They better hope they got some type of umbrella insurance.
I don’t believe you can have the minimum bodily injury liability limits and also have an umbrella. I have an umbrella and there was a requirement that my liability limits meet a certain threshold on my underlying policy.

I wonder if the single mom has Underinsured Motorist coverage? Since it’s not mentioned, I assume that she also had the state minimum and the policies don’t stack in TX.

The article says that the person who fell asleep has no assets at all. Would a primary residence be collectible under TX law?

My understanding is they usually aren’t, although if she gets a judgment she could put a lien on the home.

You be surprised. If the driver has a spouse and she has a separate policy then they can exhaust herself. Depending on state regulations.

The insurance company or attorney will file a underinsured claim against other people who live with the driver.

The reason is if they live in the same household they should be expected to be on the policy
This is not how underinsured motorist coverage works.
Underinsured motorist coverage covers the injured party in the event that the at fault party does not have sufficient insurance.

The at fault driver could be covered under a resident relative’s policy, but you could not pursue a direct action against other people who live in the household with the at fault driver. At least it doesn’t work that way in the states where I practice. (DMV).

The driver didn't own a house

They had no assets

She can sue but she won't get anything because there's nothing to take
If the driver is that broke and working she probably gets a few thousand for tax returns. I’d be going after them for years if I was Shelby

If she gets a judgment against him, he will file for bankruptcy and the debt would be discharged.
It’s really sad, but she has no means of recourse here beyond the minimum insurance limits.
