just for the sake of debate, not that I believe any of the following....

-Is there a time record/stamp that his DNA was left at the scene at the day/time of the murder?
-Maybe the location of the murder was somewhere him and his friends/associates met up/hung out. Not necessary he was at every gathering.

His team couldnt make this argument on his behalf?
