She don't have custody cause Gabriel blocked Nahla(the child) in court from moving to France with Halle and Oliver Martinez(halle's husband)



Can't move a child from her father in an unreasonable distance, judge must of felt moving to France for Nahla must of been to much of strain for the father-daughter relationship....

Imagine that Halle was the husband and Gabriel was the wife. Even if the wife shares custody with the husband, if the husband (HALLE) was the sole/primary bread winner then SHE will pay child support.

In most states, unless the parents were married previously, one parent always has primary physical custody, and the other parent has secondary physical custody even if they share custody, having shared physical in the case would be improper since one party lives in a different country. Halle most likely has joint legal custody which means she helps make decision regarding schooling, medical, etc...
