All phone carriers store text messages only until the other carrier's server (or their own server) notifies them that its been delivered OR the expry of the text message as undeliverable
With an attorney generals waiver, or a valid subpoena, the carrier can capture incoming and outgoing messages in real time, and store them as requested.
Anyone can subpoena the records, its up to the court to determine what a valid request is or is not. The carrier assumes that if it recieves a subpoena issued by a civil or criminal court, that it is a valid reason to store and release the file.

If the two of you have that policy, then fine. Not just a woman - both people have to earn trust, but there are certain ways to go about it. If I'm randomly picking up my man's phone telling people "don't text my man" without even knowing who they are to him, that is extreme and unnecessary. It's not up to me to do that. If I felt uncomfortable with someone he is cool with, for whatever reason, I'd communicate that to him and let him figure out how to handle it.
