So I got rear ended last week. We got a police report and exchanged info. My bumper is messed up and needs to be fixed, but everytime I call the insurance company, they tell we can't move forward because the other person hasn't contacted them.
It's been a whole week so I'm starting to think they won't call, but if they don't what will happen? Would I have to sue someone?

I've had this happen to me before and StateFarm cut me a check to fix my car and then proceeded to go after the guy and Geico, his insurer.
My premium didn't increase since it was not my fault.

You need to file a claim through GEICO..it doesn't matter if the responsible party hasn't contacted them, they have to file and investigate. They do this by contacting the insured and retrieving the police reports. Who did you talk to?
2.) You can file through your insurance but it's possible that your premiums may increase since YOUR coverage is the one paying out. Since you both have GEICOthis really should be simple but they need to go after the one responsible for the incident.

Thank you!!GEICO is super ridiculous when it comes to claims. Matter of fact, anyone who works for them in claims has Carte Blanche to work for anyone because GEICO is known industry wide for being beyond thorough with handling claims.
I worked for Allstate and I know for a fact that if you file, they'll hit your premiums especially since you're in Florida and because they rarely go through subrogation unless they pay out a really ridiculous amount. As long as you filed through GEICO and they (person who hit you) gave you legit info, let GEICO handle them..don't get allstate involved unless you absolutely have to.
