Call your insurance company then. Your insurance shouldn't go up. Your insurance will pay for it and charge u a deductible. Once you pay that then you can sue the person who hit you.

She's with Allstate.

Allstate hate at-fault states and FL along with GA have seen the highest rate increases YOY. If she files a claim through Allstate, they will pay out but her rates will undoubtedly go up. For one, any discounts she may have for good driving/no claims goes right out the door...secondly, if the damage is covered under her collision or comprehensive coverages, she may be penalized with a surcharge which would further raise her premium.

I had this happen to me. Dude hit me had not paid his insurance for 2 months. Called my insurance company. They cut me a check and told me to sue him. My insurance didn't go up.

The state gives flexibility to insurance companies on what they can and can not do..for example the PAP (personal auto policy) for Florida is very specific to the surcharges that must be charged to consumers, however, an insurance company can petition the state to grant them the exception of not charging the surcharge or the insurance company can limit the percentage of the rate increase they want to put on a person's policy. This is why I focused solely on Allstate. Allstate is well known for punishing folks who file claims with physical damage coverage and seeing as she has already had an accident, she'll get hit.

Time to get a lawyer so they can put their foot on the insurance company neck

When you have billions in reserves lawyers don't mean shyt. And it wouldn't help in this case. This is why you take pics of the accident before you do anything else. If you aren't killed or maimed the first thing you do after the accident is take pictures. That's the easiest way to overcome a denial for unable to contact. I overturned a denial this week because clmnt sent in pics of the accident.

GEICO is super ridiculous when it comes to claims. Matter of fact, anyone who works for them in claims has Carte Blanche to work for anyone because GEICO is known industry wide for being beyond thorough with handling claims.

Damn straight. :jawalrus: And we're also the most professional. Adverse carriers always calling in trying to act like tough guys :mjlol: and trying to rush and bully. Nah nikka, you're about to listen to my whole empathy and closing speech breh. :umad:

The same thing happened to me, and the police didnt come after waiting 3 hours and the guy who hit me tried to high tail. He then proceeded to the I dont speak English routine, lied and said he didnt have insurance then finally gave me his insurance, which I found out has over 5,000 complaints with the BBB. I called in the accident with his insurance and the adjuster would not call me after leaving several messages, blocked my number and call from the house phone and it went through. Had to call their customer service just to bypass her seeing my number. When I was called I was given the same excuse that the person involved has not responded and that given a week they will make a decision in My or His favor regardless of getting a hold of the person. After hearing this I went bizurk mind you this is 2 months after the accident, and asked her so because you dont hear from someone you assume the party involved is at fault. I was given a generic reply of we will make a decision based on the facts. At that point I called my insurance and within a week the person who mysteriously didnt answer their phone finally did and I received a check.
