JJ probably cant successfully enforce this anyway, but some workers may be too scared to test them so it is still abusive.

non competes are fine for protecting intellectual property, but most sandwiches are not proprietary in any real way. if they were, the people involved would have been paid much more than they are making now and would have had extensive training, maybe even some requirements before hiring.

the owner of this company is just an evil person.

They make sense sometimes. If I'm a doctor and I hire a kid fresh out of school I don't wan tthim working for me for 3 years, learning the ropes, then competing against me using everything I taught him. That's a matter of respect.

But they get abused a lot too

The effectiveness of non compete clauses is more based on state by state employment laws than the non compete clause...

Texas is an "at-will" employment state so typically if non compete clauses go to court they are going to side with the employee...since the employer can fire you for whatever reason...

In just the two years I worked at HP they lost virtually every non compete clause they filed in the state of texas...
