How to get past a DUI Check Point.

I was hoping the cop was gonna smash out the window with his flashlight and drag the dikkhead out the car, no luck though. The birthers, the truthers, the gun righters, all get on my fukking nerves to no end. Just answer the simple question the cop asks you and keep it moving.. In a perfect world, this guy would have got killed by a drunk driver a block down the road..

Did You Watch the video? The point is that a cop can "say" he smells alcohol as soon as you roll your window down. And can "say" your speech is slured as soon as you speak. All of the info was in the bag so their is know reason to roll the window down. And there is no law (at least in California) that requires a citizen to roll the window. This is to protect against unlawful detention nothing more. Why do you feel he's being a dikk for that?

i feel like in most scenarios like other posters said, it just brings unnecessary attention to yourself.

and it gives cops a reason to become suspicious.

but if you believe in giving cops a hard time, so be it, things won't always turn out how you see it on youtube and you may end up yanked out the car

are DUI checkpoints legal then? Doesn't that constitute unlawful search and seizure? I want to say I heard some crap before about them getting away with it because they "notify the public" that they will be doing these things so if you drive into one it's your way of saying you want to be stopped...

DUI checkpoints are legal as they are a way to provide public safety. However, there are a number of rules to follow. There is a number of forms that need to be filled out before and after a DUI checkpoint is performed. Stats and information is taken down. This prevents the police departments from getting sued for not performing a DUI checkpoint in a legal manner. Usually, the person running the DUI checkpoint needs to work with a specialist to make sure that the location of the checkpoint is in a safe and allowable location. They aren't going to put a checkpoint in the middle of a bridge or tunnel, or around the bend of a sharp corner or right after a railroad crossing or on private property.

Unconstituional search and seizure would mean the driver did not give consent to search the vehicle. However, vehicles driven or parked on public roads where illegal items are in plain view are subject to search and seizure. Having an open container (of an alcoholic beverage) in plain view would give probable cause for the officer to stop you at a checkpoint and get the container to obtain for evidence. You should Google "search and seizure". It's obvious you don't understand that law since you are relating it to DUI checkpoints in a broad manner.

no it's obvious I don't fully understand the law because I flat out asked for more information regarding the law from someone more knowledgeable on the subject. My bad I don't know everything about everything.

In Massachusetts they legally get away with it by saying that that stretch of road is hazardous and "x amount of accidents" happened there so they are doing a "safety corridor" to "assist with public safety".

I'm about to be commuting every day from Middleboro to Providence Theres usually not traffic until you hit downtown PVD, and that's because of the construction they're doing by the mall..


On my way home to Fall River from Middleboro is on 24...fukk ass construction everywhere.

I'm up near Lawrence so I can either go 495->95 or 93->95 to get to provi. I'll take 495 during rush hours to avoid that mess but it adds 25 miles to my trip. I actually take that Provi Mall exit to get to my spot - they finally finished it so its all good over there now.

the cops didn't want a hard time so they just let him go. they knew he was a jackass.

i don't consider dui checkpoints a violation of my rights. it serves its purpose, especially if you have lost someone to a drunk driving accident. this idea of an us vs them mentality is toxic to our society.

if they wanted to search my car that might be a different story. however, trying to find loopholes to get drunk drivers off the hook is not cool in my book

Yeah they changed that exit so it takes you directly to the mall. Helped out a ton. They're doing work on exit 21 and 22 to help fix that shyt up because its ridiculous. These morning commutes from Pvd to Middleboro are gonna have me like on 95/195
