The story has a lot of holes in it and that's where the whole "it's up for interpretation" thing comes into play. However, not getting consent and having sex with someone is rape. I am not sure if I could classify this as rape personally, given the fact that the story made no sense and jumped from one thing to another. Objectively speaking though, rape is non consensual sex. Obviously you don't have to ask for permission if its your girl, it's implied that its consensual, however if she says stop you gotta stop. If you keep going, that's rape.
