It’s illegal to explicitly discriminate, even for Black people
for some reason, meaning you can’t have discrimination in writing or as part of your marketing materials.
You CAN however state that your community is based around the interests that coincidentally are aligned with Black People’s interests or coincidentally in an area with a lot of Black people.
You can’t say nonBlack people are not welcome, but you CAN say that the interests of NonBlack people don’t align with the community’s values or don’t meet some other arbitrary qualifications.
Let’s say you were building a “Hip Hop Community.” That doesn’t bar anyone in particular from being interested and putting in a bid, but you can arbitrarily say that certain people’s values don’t align with Hip Hop culture and thus will not be considered a viable applicant to that community. Coincidentally a lot of those people are nonBlack.
That would be legal because there is a qualification there that anyone can meet and anyone can apply to even tho it’s heavily
no one can prove or disprove that’s truly the case, legally speaking so long as no proprietors are caught on record saying anything
