if someone dies and their credit card is maxxed out who pays for it?

from what I’ve learned, the debt is passed to the next of kin.. so their spouse or children.

Who ever is in charge of the estate has to pay taxes on whatever 1099-c form they recieve.

It just doesn't dissappear since that debt becomes earned income (hence a 1099 -c form)

It doesn't work like that.

The money is taken from the estate. If not enough money is left behind, the beneficiaries will receive nothing.
