I have a smartphone, they can track where I am, that's fine. There's nothing on my phone that's constantly capable of taking video of me and that I can't disable. These things are not even comparable.
The kinect can be disabled. And your phone camer can be enabled without your knowledge if someone wanted to spy on you.

Microsoft is openly stating they are going to invade your privacy. Hard body. Which is against many laws and if not its at least against morality.
Can you provide a link to some paperwork from cellphone companies openly stating that they invade your privacy through unwanted surveillance and recording?
