I agree with all that but those are the cases that I'm certain will get thrown out. If boy scouts/frats aren't letting homosexuals in (or kicking them out for being homosexual) then obviously that's against the law but as far as I'm aware that's not how it is. So there's no leg to stand on for that.

Do you mean it SHOULD be against the law. Currently it is not against the law for a private organization to include or exclude whoever they want. It's just like here at the coli, if we decided to exclude certain people for ANY reason.
The government couldnt step in and force us to change our policies.
the-coli can decide to exclude a certain person for any reason, but if the the brooklynzson and bkdagawd decided to permanently ban people based on sexual orientation, then there might be legal precedent for fighting that.
but i don't discriminate on people.
