nah i think technically they can still sue you even if its not for sale . If kanye came out with a free tape I dont think he could just use whatever sample he wanted and not have to clear it especially if he performs the songs.

Plus a lot of these underground cats releases are all over Spotify, etc and iTunes. Madlib got tons of shyt for sale all samples and i remember an interview where he said he's only been sued once in his career for sampling.

I think its just because they dont generate enough $$$ to make it worth the lawsuit. :yeshrug:
That's why I said people sample on mixtapes. You don't make any money off of it. So they can't sue

Few artists have the dough to clear samples, Drake is one of them, but I'll say this, his producer's ears for music are very sharp, objectively speaking.

are nikkas like this even clearing the samples though? Or are they just not popular enough for lawyers to bother suing? Because you look @ nikkas like Roc Marci, Alchemist, and now you got that nikka Daringer with WSG/Conway....and I always think to myself "how they afford these samples?"

Madlib is definitely mainstream enough to be on a lawyer's radar....he produced "No More Parties In L.A." for Kanye and Kendrick, which featured a blatant Junie Morrison sample:



So I guarantee he clears all his samples.

As far as Freddie Gibbs....it's not that him and other underground/indie rappers are so unknown they can use samples with impunity....it's just, realistically how much can an artist charge them to use the sample?

It's not like they're selling 2-3 mill, got multi-million dollar endorsements, and all this other shyt. If Madlib calls up....let's say Issac Hayes estate....and says "hey, I want to sample 'Wherever You Are' for a Gibbs record, how does $5,000 sound?"....the estate can say yes or no but a no means 0 dollars. And they don't have any leverage to ask for some ridiculous amount of money, either.
