It was definitely based on real events. Remember, this aired during the Bush era when they were outright torturing folks. That's why I say 24 had to be a state-sponsored show (US government sponsored). It's pro-torture, pro-wiretapping, pro-taking away American's freedoms, etc.
In the episode I was watching last night, the Secretary of Defense was having a debate with his son, telling his son to tell CTU what they wanted to know, and his son was arguing for his right to privacy, and the dad was telling him, you have no privacy, the US government takes precedence.
I think folks from the Bush administration were feeding some of these storylines directly.
