They claim now he was smoking weed and that is why they stopped hi in his car, they then said they came to him because of the weed and saw the gun.
Then they claim he had his gun out and brought it out of the car with him and they shot him.

they've yet to show the gun.

They did sneak in he had a ankle holster, but makes you wonder why if he had a ankle holster would the gun be out.
