Well if all they have for a eyewitness is a bum, you might be good. It should be easy for a good lawyer to discredit him. Especially if he has a long history of mental illness and substance abuse.

Get your lawyer to prove the homeless bum waste of flesh has impaired vision and can't pass an eye exam. Also depending on the time of day or night, his vision is definitely going to be questionable.

Does the bum have a history of substance abuse? If so, what are the chances he was sober and able to see clearly when he was allegedly attacked? What was the weather like? If it was cold, what was the bum wearing or wrapped in that may impair his vision? If he was cold was he drinking anything to stay warm?
