now this is my beat which was stolen from me before i knew about copywriting, i gave this to a manager who promised placement, it got placed alright, without my permission or anything, they never gave me credit, this is a commonly sampled song, but i got nothing and while i attribute this to being my fault, it wasnt fair. i didint deserve to go out like that

this was my original instrumental. so trust me, i know the feeling. i was more than happy to pay the clearence fee etc, but nope, nothing. in the end i got fukked and i couldnt do shyt about it.


some of these songs that were played manually by these artists have been used as the foundation of an entire genre, you telling me they dont deserve at least 50 cents for their hard work per song?

thats why i am not exactly mad. artists sample (especially me) the fact is, i didint personally play it, thus if i made money, so should they. its fair

You make some good points. But its easy to just say "ya they deserve a little money for their hard work"... the problem is if the legal system takes that stance, producers are shook.. Of course a superproducer like Kanye isnt gonna be worried about clearance money, but what about some dude just starting out?? At that point its inhibiting creativity, which is why I fukking hate when artists sue over sampling

They arent getting "rich off of your work" (and its not even their work anyway, its their dad's)... they're artists, and sampling is part of their art.

That's all well and good, but still.....if you're gonna use someone else's shyt in your art (particularly with the intention of making money from it), make sure you have the appropriate permission/authorization. If you're not for doing that, then come up with your own shyt to make money from. Simple.

nikkas talkin' about "oh, it's only one phrase/one break" or whatever.....sometimes a short sample can end up being used in a whole bunch of songs that make a ton of money.....meanwhile the ORIGINAL creator of the sample gets nothing.....oh but that's OK because it was only a few seconds anyway :rudy:. Well if it was only a few seconds/so unimportant, then why not leave it out of the song? :usure:

man idk its complicated. I totally buy that argument. Like I know Clyde Stubblefield, one of the most sampled drummers ever lives in my city, and he hasnt seen a dime. Which is kind of unfair.. but on the other end I just think its fukked up that these lawsuits can be intimidating to up and coming producers.

Im a producer myself, and some of the artists Ive sampled are pretty big (Pink Floyd, Led Zeppelin etc), and it sucks to think that Id have to make decisions about my use of sampling if I ever started to blow up

Those cats are about to get PAID if this goes through. I'm naive on this whole subject but wouldn't it be easier to just ASK the original creators of these songs for permission to use them BEFORE you use them? I'd think most artists would be more than glad to have a new generation of people appreciate their work.....unless the song/artist is reprehensible to the original creator.​

That's a good point because I've been wondering for a minute how much The Winstons (or their descendants) got paid for the 'Amen Brother' sample and how much ESG got for 'UFO'. Then again, I think the producers of those songs would be the only beneficiaries due to publishing rights.
