Theft? Confiscation is not theft. Furthermore, at the beginning of every school year, students and parents are supposed to sign an agreement to follow the county/school system rules. And I’m pretty sure the student would get the phone after class. That’s normally how the policy is enforced. If you don’t want your child to follow those rules, move them to a school district with different rules.
Or how about you (every parent) just teach your child to follow the rules and not be a disruption in class. That would solve everyone’s problem

According to the TN Board Of Education Policy Manual, Code 6.312, school staff can legally confiscate cell phones.
So no, he didn't "steal" anything.

But you want poor kids to keep falling behind while the parents and educators of the rich kids put them in position to succeed.
remove teh kid from teh class room into an auxilary room with other kids that were being disruptive with their phone or not following the no phone rule. increase penalties with academic assignments to regain entry to their assigned classroom if they want to learn along side their friends/peers. phones are not gameboys or walkmans, they are very personal devices that shouldn't be removed from the owner so they should just remove the owner of the phone.

There's no real need to take phones away from students. It just causes trouble. Also, what could happen if the student has a legit need to keep it on them?(medical condition, expecting a phone call, etc..)
If anything, just dock points or shyt from them anytime you see them using it. Years ago one of my teachers did that lol
