A judge has sentenced a Portland man to 7 ½ years in prison for shooting and killing his sister’s boyfriend last year.

Mark Cardilli Jr., 25, was initially charged with murder in the death of Isahak Muse, 22. Superior Court Justice Nancy Mills presided over a bench trial in December and ultimately found Cardilli guilty of the lesser offense of manslaughter. She also decided his sentence during an emotional hearing at the Cumberland County Courthouse in Portland on Monday. The total sentence is 11 years, but the judge suspended 3 ½ years.

“I expect no one will agree with this sentence or like this sentence who is in the courtroom today,” Mills said.

Cardilli has admitted to killing Muse during a fight at the Cardilli home in Portland’s Riverton neighborhood, but he said he was defending himself and his family. The prosecutors from the Maine Attorney General’s Office argued the law did not allow Cardilli to use deadly force during that confrontation in the early morning hours of March 16, 2019.

Muse came to the house that night to spend time with his girlfriend, Chelsey Cardilli. Her older brother had recently moved home after serving five years in the U.S. Army. The fight started as a dispute over whether Muse could spend the night at the Cardilli home, and the entire family was involved in a verbal and physical altercation before the shooting.

The Cardillis are white, and Muse was Black. Since the first days after the fatal shooting, the role of racism has been a constant question. While police investigated the incident, local Muslim leaders voiced their concern that it was a hate crime. When Mills set bail at $50,000 and allowed Cardilli to wait for his trial at home, protesters questioned whether a Black defendant would have had the same opportunity. And when Chelsey Cardilli took the stand at the trial, she said her brother made racist statements about Muslims, Somali people and Black people.

On Thursday, the defense called forensic specialist Jonathan Arden, trying to determine the angle at which Muse was standing when he was shot. Arden said he had “no material disagreements” with Dr. Mark Flomenbaum, the state’s medical examiner who determined that Muse was shot from behind with the muzzle of the gun pressed against his jacket, but questioned whether a third bullet, which seemed to graze Muse’s hand and brow, had also been fired from behind.

— In an effort to justify the use of lethal force by Cardilli Jr., the defense opened the day Wednesday
hearing testimony from the Cumberland County Sheriff’s office, which had listed Isahak Muse as 6’0” and 150 pounds. The state’s medical examiner said Muse was 5’9” and 139 pounds at his time of death.

Cardilli, who is 5’7”, said in interviews with police that he feared that Muse would physically overtake him and his father as they attempted to remove him from the house.

— On Tuesday, it was revealed that Cardilli Sr. told his son that he did not know that the pistol used to shoot Muse was real.

“I thought you were trying to scare him,” Cardilli Sr. had said to his son in custody immediately after the event, as recounted over video evidence played for the court.

“I wasn’t going to play around anymore,” Cardilli Jr. told his father.

Cardilli Jr. had reappeared with a gun and said he would shoot Muse if he did not leave, according to Chelsey Cardilli. The two exchanged punches.

“Shoot me, it will be on the news,” Muse said while Cardilli Jr. had pointed a gun at him, according to testimony from Chelsey Cardilli.

Murder suspect’s mother says she has foggy memory of son’s shooting of Isahak Muse


PORTLAND, Maine — The mother of Mark Cardilli Jr. struggled to remember details of the fatal incident at their family home on March 16, which resulted in her son shooting Isahak Muse with a pistol.

Suzanne Cardilli told the courtroom on Wednesday she didn’t remember answers to specific questions asked by state attorneys. And many of the details she provided contradicted her own account told to police hours after the event.
Suzanne Cardlli testified that Muse, a guest in the house, slapped the phone from her hand as she attempted to call 911 as an altercation broke out between him and Cardilli Jr.

But that testimony is inconsistent with statements she made in previous video recordings replayed in the courtroom. Initially the woman did not say Muse had grabbed, slapped or punched the phone after being directly asked by police.


“I tried to call 911, but my phone — I don’t know why — didn’t do it.” Suzanne Cardilli told police in March.

The night of the incident, three members of the Cardilli family told Muse he needed to leave by 1 a.m., according to testimony and other statements. But Muse, who lived in South Portland and had been dropped off at the house, refused. With the aid of his girlfriend Chelsey Cardilli, he attempted to negotiate invitation to stay the night, as had happened many times before.

Between 1 and 2 a.m., after an attempt by Mark Cardilli Sr. and his son to physically remove Muse from the house failed, Cardilli Jr. shot Muse. A state medical examiner said the bullets were fired at “close contact” and two entered Muse through the back.

Suzanne Cardilli said Wednesday that Muse was “disrespectful” and “rude” the night of the event as he tried to negotiate an extension.

She later said that Muse had frequently been given permission to stay the night at the Cardilli family home at 107 Milton St.

Other accounts Suzanne Cardilli offered Wednesday also differed from accounts she gave to police in March, which were played as courtroom evidence. She told the defense on Wednesday that she left during the altercation to go to a neighbor’s house, returning to find Muse on the ground for the first time. That account disputes what she told police hours after the event, when Suzanne Cardilli said that Cardilli Jr. had Muse on the ground during the fight.


“I don’t know about my memory anymore,” an exasperated Suzanne Cardilli said to state attorneys on Wednesday.

The trial of Cardilli Jr., who shot and killed Muse, began Monday. While his family was from Somalia, Muse was born and raised in Portland and attended Deering High School. He would have turned 23 on Tuesday. He had been Chelsey Cardilli’s boyfriend for about a year before his death.

he was 21 dating a 16 year old... :gucci: got told by juvie court to stay away.

then he came back knowing she got a older racist bro who just came back straight from the military , you know the dad was :angry: the whole time too

The law is a joke. 7 years, providing he commits to studies/learning a skill, is not lost time. It isn't even a slap on the wrist.

Why would dude even put himself in that situation? Was probably talking all kinds of mad shyt trying to spend the night. Ain't no grown ass men bout to let you bully them in their own house buddy:mjlol:
