I think the crime here is actually prescription fraud. Just so happens that if someone dies in the commission of a felony (in this case, the unborn baby), it's automatically first-degree murder. Same way that if a robber broke into the house and kicked her in the stomach during a robbery, he'd be charged with first-degree murder.
