Because it ain't that deep to Marvel.
Hell, they actually filmed a scene in the first "Ironman" movie with Ghost, but they cut it out due to the movie going too long.
And the song Jon Farveau (director of the first "Ironman") used to announce he was directing it was "Return Of The Ironman":
So I assume they have no problem with him.
Not sure about this. It's possible he's under the radar enough they don't care, or maybe they just don't care like with Ghost.
