1. He was blackballed.
2. Jim owned his catalog.
3. He was not up next.
Amalgam won their court case against Jim in 2010, and dropped his album the next year. After that they sold his catalog to Phase One.
Max didn't own his music during his years out, and he was blackballed heavy. I can't picture any way he was going to be up next if he was out. We'd have to go back 10 years, to the point where he never signs with Jim in the first place. At that point we're treading on science fiction and literally anyone could be called up next.
