SAN FRANCISCO (AP) — A federal appeals court has denied the Justice Department's request for an immediate reinstatement of President Donald Trump's ban on certain travelers and all refugees.

The 9th U.S. Circuit Court of Appeals in San Francisco instead asked both the state of Washington and the Trump administration early Sunday to file more arguments by Monday afternoon.

The Trump administration appealed a federal judge's ruling that temporarily placed the ban on hold. The higher court's denial of an immediate stay means legal battles over the ban will continue into the coming week at least.

Acting Solicitor General Noel Francisco forcefully argued in the government's brief Saturday night that presidential authority is "largely immune from judicial control" when it comes to deciding who can enter or stay in the United States.
This is so going to the Supreme Court. Like I said in another thread, Trump is going to wait until his boy gets confirmed to get the 9th judge and the 5-4 Conservative advantage in hopes that he wins. Not sure that will happen though.

because of this every appointed judge will be ultra conservative now

That would be the case regardless, it's not like Trump was ever going to appoint moderate judges.
his other possible supreme court nominee, Thomas Hardiman is a not an ultra conservative, he has gone against conservative thought many times in his rulings

My guess is that Trump/DOJ waits until his Supreme Court nominee is confirmed (to avoid a tie), then takes this to the US Supreme Court for a final decision in hopes that the 5-4 Conservative advantage rules in his favor.

I don't know though. After this ruling from a judge appointed by W, does anyone see one Supreme Court Conservative deflecting to the Liberal side in this ruling? 5-4 against the Executive Order?

The order has many different orders within the order, in an actual decision the judge would have to make a decision on every sentence in the order

Right now people and the media and now this judge are conflating everything contained in the order

But in a judicial review the government will win because most of the order is perfectly legal

The only part that is legally dubious is the green card issue because of due process

The problem is the wording and intent. He and his surrogates have phrased this as a "Muslim ban" not the greatest idea if you want this to stand legally.

Robarts is not conservative. He was appointed by Bush so no doubt he is a globalist.

the judge overreached, the only part of the order that is legally dubious is blocking people with green cards and that is why all the other judges focused on that and that is why the administration backed off on that

all the other parts of the order are perfectly legal, there is no law that says people have a right to immigrate

They are entitled to due process. Unfortunately for the other parts are applicable however citizenship doesn't really mean much nowadays.

Edit: Trump is using same law as Carter for the temporary ban muslims from lran

That's right. Trump loves to be adored. The more distance between the two the better in this case. I'm glad this is happening now instead of later.
