Me and my bf got into a huge fight tonight over that goon that was tryna kill me and he tried to break my wrist. I called the cops but refused to press charges because he is on probation and i dont want him to go to jail. I started the fight. The cop said that he might still go to jail because he has a a prior dv charge that he served time for which he is still on probation for now. He said even if i dont press charges the da might. Im so sad i should have never called the cops. Is there any way i can fix this without getting in trouble i want to get it reduced to self defense but since i had a cut on my finger it might be hard

From here on out, It is all about evidence if the DA brings charges on behalf of the State against him.

Anything you could have said to the police that could incriminate him are hearsay statements and are inadmissible against him even if the police put it in their report.

Unless when you said it you were in shocked state which will fall under a hearsay exception known as excited utterance.

If you were calm and the police came like say an hour later then it does not fall under this exception. They likely will not get it under a hearsay exception such as excited utterance and I will advise if you want to keep him out of prison, just be uncooperative in their investigation.

The State from what you are saying so far does not have a strong case and will likely not even bring this up. (Unless he violated conditions of his probation)

And as far as Domestic Violence , putting your hands on each other is never the way to solve disputes if you truly love each other. It always ends bad in the long run.

The police came immediatley after i called them which was 5 minutes after it happened we were fighting in the car and i jumped out the car and ran so it was all very fresh when the cops came. He told the cops that i threw rocks at his car which i did so its basically my word against his . Im not sure what the exact terms of his probation are but he did have to take anger management which he did and hes been doing good he just had a little slip up. Should i call his parole officer or wait til monday and go down to the DA? As far as i know he hasnt been arrested. The cop told me if i refused to press charges they would likely throw out the case unless the Da wanted to prosecute him. Given his criminal record im scared they might but i dont want my baby to go to jail yes he put his hands on me but it wasnt his fault and even when he was trying to break my wrist he let go asap once i started screaming. This whole situation is such a mess
