It's honestly both. Many criminal offenses are performed due to underlying issues in mental health. But the persons mental health does not excuse them from the consequences of the crime they committed. This is where that whole issue of lack of rehabilitation resources in prison is driving recidivism. Everyone needs mental health check ups. Should be like going to see a doctor for an annual physical or the dentist for a semi annual cleaning
