Looking at the story, he bought used games but they were actually MIG cartridges.

So he got scammed on eBay then Nintendo punished him for having pirated games.

That wasn't explained in the article. He bought original cartridges but the games were dumped on MIG. The seller most likely bought the games, ripped them played the copy and sold the original cartridges to this user.
