The key question is still: did the victim consent or not? Regardless of whether the victim was drunk or sober, if the sex is nonconsensual, it is rape.

How is that overeaching(?)/overeacting (?) Have you been accused of rape before or had someone lie on you about rape? I have had that happen to someone close to me and even though he was found innocent in the end it was a big mess.
