I'm not here to argue the merits of the ruling; but I think if this reached the highest court in the land…he would probably win. His argument of his political identity being akin to religious affiliation of one member is pretty weak, but a seasoned constitutional, white shoe attorney certainly could make the case imo.

I see them taking this pro bono with the right grass roots money behind it.

Either way, the ideological interpretation of this matter would probably be tipped in his favor based on the SCOTUS and the way it is set up.

They don't take most cases, so that's a safe bet to take…but it depends on the political capital backing it.
