An Oklahoma inmate who served more than 28 years behind bars was released from prison after a judge overturned his conviction for a 1991 murder.

Corey Atchison became a free man Tuesday after Tulsa County District Judge Sharon Holmes concluded he was innocent in the slaying of James Wayne nearly 30 years ago. Police have said that the victim was fatally shot during what appeared to be a gang-related robbery back in 1990.

Attorneys argued Atchison’s conviction was based primarily on the account of a single witness, who has admitted he was coerced into testifying against the 48-year-old Tulsa man.

Atchison, who has always maintained his innocence, had been serving a life sentence in connection with Wayne’s death. He was only 20 years old when the incident occurred.

He’d been in the area with some friends at the time of the shooting and arrested six months later.



Holmes’ finding of “actual innocence” makes Atchison eligible for up to $175,000 in compensation for a wrongful conviction under Oklahoma state law.

Prosecutors have already filed a notice appeal on the ruling while former District Attorney, Tim Harris, who prosecuted the case as assistant district attorney, has filed an affidavit denying that he’s ever coerced a witness.

Tulsa County District Judge Sharon Holmes is in the hospital after being stabbed in her home in what police confirmed Thursday is being investigated as a possible domestic attack.

A Tulsa police report obtained by the Tulsa World indicates officers responded to Holmes’ home Saturday evening after a relative called 911 to say she saw Holmes lying in a pool of blood in her kitchen with a knife in her leg. The document shows the report writer said he was instructed by a supervisor to “title this report an accidental injury.”

A separate internal memo from a shift supervisor early Sunday said police believed the stabbing was accidental and self-inflicted, as there were no signs of forced entry to the home. Officers also cited in the police report statements from the relative about Holmes falling on the knife while the relative was in a different room.

But Sgt. Shane Tuell told the World on Thursday that officers are now investigating the incident as being a possible act of domestic violence. He did not comment on what prompted the change in classification but said the investigation remains open, which means the Tulsa County District Attorney’s Office could receive a report recommending criminal charges.

“It’s a domestic violence investigation, and it appears there may be an internal investigation surrounding the issue, as well,” Tuell said. He did not specify what about the handling of the matter could merit the opening of an Internal Affairs probe.

Holmes was sworn in as a district judge in 2015 and is the first black woman to be elected to the position. She won re-election in November.

The World generally does not identify reported victims of domestic violence but did so in this case because the allegation involves an elected official who is also regularly in the public eye. The World is not naming the relative or specifying the nature of the relationship because she has not been charged with a crime.

According to the report, the relative said she did not hear Holmes fall in the kitchen and reportedly varied emotionally from “screaming” at officers to being “fairly calm and cooperative.”

“She would then accuse officers of treating her as a suspect,” the report states. “She would bounce back and forth frequently and without warning.”

Holmes remained in the hospital as of Thursday evening, Tuell said. The incident resulted in a deep laceration to the back of her left leg and what police said was a “severely broken” ankle.


Tulsa County Presiding District Judge William Musseman said he was made aware Monday that Holmes had a serious medical emergency. He said other district judges will continue to help handle Holmes’ felony case docket until she is able to return to work.

In the police report, the relative said she and Holmes had a verbal argument over another relative being in intensive care at a hospital. She said she then left Holmes in the kitchen while she went to the living room.

Shortly afterward, the relative said, she returned to the kitchen to see Holmes lying in a pool of blood. Police said they saw a large kitchen knife in the sink that had blood on the blade and reported that the tap was running when they arrived.

“(The relative) further stated that Ms. Holmes began to lose consciousness so she slapped/struck her several times in the face to try and keep her awake while waiting the arrival of EMSA,” they wrote. “(The relative) was very adamant that officers know that any additional injuries to Ms. Holmes’ face were from her trying to keep her awake.”
