It's not that easy
If their policy is to not confront customers then the company is not liable..they have already distanced themselves from him for a reason. Dude was the manager. If he told an employee to do that they'd charge the store 100%. As it is the victims would have to prove that the chain and manager has a history of doing this to get a payout.
