It's hard to tell whether Papa John's really is at fault or their third-party vendor went overboard with texting ads to get more revenue, which would put them at fault. It wouldn't surprise me if they lose with a settlement of like $0.10 per text, which would result in $0.066 per text after the law firm gets their 1/3 cut of the settlement. So, that would be like maybe a $1.00 check per customer who got texted.

Quiiiiiick sms marketing fact: He probably paid a black hat marketing firm to do this because it's almost the same technique the spam bots on twitter spam as well.
