Patents, Trademarks, & Copyrights?

This thread is for asking/answering questions about patents, trademarks and copyrights.

Here is my question:
If someone went to a chemist and wanted them to help them create a formula for a product, how would they be able to make sure that the chemist wouldn't steal it? I assume they would need a patent? But wouldn't they need the formula before they could get a patent? How does it work, how much does it cost, and how long does it usually take? I think you would need a lawyer. Same with trademarking a name for a brand/product, How long would that take and how much would it cost?

Get a lawyer and make the chemist sign an NDA. Not sure how much patent applications cost.

Trademarks are $275-$325 if I'm not mistaken, takes a few months for USPTO to process them
How much would a lawyer for that cost?

Its not going to be a NDA, in the employment contract you are going to have to draw up that all development of ideas and etc are product of the company. You can add a Non-compete clause after termination as well.

non-compete clause is in the case of termination, they can't work with a competitor in the same field for a certain length of time.
I would definitely talk to a lawyer and ask him about your respective state and IP laws with regard to structuring your employment contract to include clauses that all IP developed is the property of the company or something like that.

Trademarks are for Names, Images and Ideas....

Patents are for designs and inventions...

Legalzoom.com is your friend buddy, they helped me alot on my Aaron Jackson Logo and trademarking, and LLC...
