JPZ did the hook and the beat, its possible he jacked it from Oschino. As for 40 biting, his verse sounds nothing like Oschinos or Butter Knives verses, and conceptually coming up from the dirt, or the bottom up or however you chose to phrase it is not a new groundbreaking concept in rap. In fact, its a topic 40 has covered previously, before anybody outside of Philly even ever heard Oschino rap.
