Police Officer Was Fired After Her Was Caught Getting Drunk In His Uniform

MIAMI BEACH (CBSMiami) — A Miami Beach cop accused of being intoxicated, in uniform, while working off-duty at a South Beach night club is now out of a job.

Sgt. Mike Muley was terminated Friday, according to Miami Beach Police.

In a statement released Friday, Chief Daniel Oates said, “My action speaks for itself. This officer terribly embarrassed the Police Department and all his peers, as well as the entire City of Miami Beach.”

Muley’s attorney, Eugene Gibbons, released a statement on the firing saying, “We are disappointed with the City’s knee jerk reaction and we look forward to having an independent decision maker reviewing all the facts and circumstances of this case. We are confident Sgt. Muley’s termination will be reversed.”

Muley’s firing comes eight months after an anonymous call in which the person said there was an intoxicated police sergeant, who was working an off-duty job at Mango’s Cafe on Ocean Drive.

As part of the on-the-job investigation, Muley was transported to Mt. Sinai Hospital for medical treatment and alcohol testing. Chief Oates had said he would wait for the investigation to conclude before taking further action.

Muley had also been disciplined in the past for his “lack of supervision” in the 2011 case of another officer drinking on the job. Derick Kuilan was sentenced to 18 months in prison for a drunken ATV joy ride that critically injured two people.

Muley, who took the stand during Kuilan’s trial, was demoted for gross negligence, but was later re-instated to his position.

The Mango’s incident also affected the department as a whole.

Once the incident happened, big changes were made to the policy when it came to officers working off duty at night clubs.

Miami Beach Police officer have since been required to get proper training, rotate shifts every few hours, and can no longer eat and drink where they’re working.
