Yes he can. These aren't 2 strangers, so the history of their interactions will matter in a trial. For all we know dude who got shot was a habitual line stepper and this wasn't his first time putting his hands on a coworker.

He wasn't being beaten up. He wasn't on the ground getting stomped. The other guy didn't have a knife or a bat.

The guy got punched, he could've turned and ran away. Or just walked away.

Some states have a duty to retreat. But imminent threat and/or bodily harm falls within self defense statutes. I'm pro gun. But shooting someone because you got punched ain't enough.

He didn't get rocked or dazed. He wasn't getting combo'd. He's gonna do a bid.

If you watch really closely it looks as though the shooter (blue jacket) actually swung first. The camera pans to them just as the shooter lunges or something, and by the time things come into clearer focus we see the victim punch the shooter once, and then he gets shot. I bet the whole thing was caught on the Popeyes cameras.

Idk how it would be self defense if dude didn’t have a gun and his life was never in danger
