Once again evolution isn't a step wise process. Evolution does not say that humans and apes evolved from each other. they just share a common ancestor that they both evolved from millions of years ago.

A theory is something that's stood continuous tests and has yet to be proven false. It doesn't mean what you think it means. Science is actually humble in that even if they're 99.9% sure about something, they still consider it a theory, as it continues to hold up to peer reviewed tests.
